Terms & Conditions

Claims

- All claims must be made in writing within ten calendar days from date of delivery. Any claims thereafter will not be acknowledged.

Credit and Terms

- To those who have established credit with us, payment is net 30 days. If you do not have an established account, cash down payment of 25% is required with your order and the balance due 28 days prior to shipment.

To establish credit, a confidential credit application can be obtained form Bob Young's Nursery. This credit application should be completed and returned at least six weeks prior to date of shipment. Customer will be advised of a credit status prior to shipment. All accounts over 30 days are subject to a service charge of 1½% (18% annually). In the event that the entire unpaid balance of this bill becomes due and payable, the buyer agrees to pay all expenses of collection, including reasonable attorney's fees and court costs.

These terms shall be interpreted in accordance with the laws of the state of Tennessee and courts of Warren County, Tennessee shall have exclusive jurisdiction over any disputes arising from any transaction.

Guarantee

- All nursery stock is sold subject to the standard no-warranty caluse; "We give no warranty expressed or implied, as the description, productiveness, or any other matter, of any nursery stock, seeds or bulbs we sell. We shall in no case be liable for any sum greater than the amount originally received for any stock." We cannot guarantee plants to grow because we have no control over the plants after they leave our facility.

Cancellations

- Any cancellations must be made in writing and received by us prior to January 15th. If you cancel your order after it has been dug, you are responsible for the total value of the plant material. You will be invoiced accordingly. If the material has been graded and tagged but not dug, it is subject to a 10% cancellation charge.

No Hold on Plants

- All nursery stock orders will need to to be shipped in full to customers by May 1st. We will not hold any plants over this date unless prior arrangements have been made. Weather permitting may extend our shipping season, but we will make ever attempt to have you your material before May 1st.

Shipping Freight Charges

- We arrange for bulk shipment of stock by independent truckers and brokers who specialize in hauling nursery stock. Our stock is packed with the greatest of care, therefore our responsibility ends upon delivery in good order to the carrier. All stock travels at the expense and risk of the purchaser. Freight charges are payable at time of delivery. For less than trailer load quantities, we will try to help arrange a combination load.

We assume no responsibility after stock leaves our facility. Stock damaged in transit by delays, neglect of carrier, or any other cause beyond our control is at your risk and is between you and the carrier. With proper notice of error, our liability is confined to replacement or refund.
